Welcome to AV Creations! The terms “we,” “us,” and “our” refer to AV Creations. We operate this store and website, including all related information, content, features, tools, products, and services (the “Services”). The Services run on Shopify.

These Terms of Service, together with any policies referenced here (“Terms”), outline your rights and responsibilities when you use the Services. By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Access and Account

You confirm that you are at least twenty-one (21) years old, the legal age to purchase vapor products in the United States. Any minors using devices you own must not access the Services.

To shop online you may need to provide information such as email, billing address, and payment method. You warrant that all information you provide is accurate and complete. You are responsible for keeping your account credentials secure and for all activity under your account. Account transfers are not allowed.

2. Our Products

Colors and appearance can vary by device. We do not guarantee that product images or descriptions will match delivered items exactly. Product descriptions and availability may change without notice. All AV Creations e-liquid is sold as zero-nicotine short fills intended for legal post-sale nicotine addition.

3. Orders

Your order is an offer to buy. AV Creations may accept or reject any order in its discretion and must process payment before accepting. Cancellations may not be possible after acceptance. We will try to notify you of any changes using the contact details you provide. Purchases follow our Refund Policy. You agree that products are for resale to end consumers within your licensed territory only.

4. Prices and Billing

Prices, discounts, and promotions may change without notice. The price shown at checkout is final for that order. Prices exclude taxes, duties, shipping, and handling unless stated otherwise.

You agree to keep all purchase and payment information current and accurate. You confirm that you are authorized to use the chosen payment method and will pay all charges, including taxes and shipping.

5. Shipping and Delivery

Every order is packed and handed to the carrier within two business days of placement. Carrier delivery times are estimates and not guaranteed. AV Creations is not liable for carrier delays or events beyond our control. Title and risk of loss pass to you once the shipment is handed to the carrier. See our Shipping Policy for details.

6. Intellectual Property

All trademarks, logos, text, images, audio, video, and their arrangement in the Services are the property of AV Creations or its licensors and are protected by intellectual-property laws. You may use the Services only for personal, non-commercial purposes. No content may be reproduced or distributed without our written permission. Shopify trademarks belong to Shopify Inc.

7. Optional Tools

Third-party tools are provided “as is” without warranties or endorsements. Your use is at your own risk. Future tools or features added to the Services are also covered by these Terms.

8. Third-Party Links

Links to third-party sites are provided for convenience. We do not control or endorse these sites and are not responsible for any losses arising from their use. Review third-party policies before any transaction.

9. Relationship with Shopify

AV Creations is powered by Shopify, but all sales are directly between you and AV Creations. Shopify is not responsible for any aspect of those sales. You release Shopify and its affiliates from all claims related to your transactions with AV Creations.

10. Privacy Policy

Personal information is handled according to our Privacy Policy and Shopify’s privacy policy. By using the Services you agree that your data may be processed in other countries to operate the Services.

11. Feedback

Submitting feedback grants AV Creations a perpetual, worldwide, royalty-free license to use, reproduce, modify, and display that feedback for any purpose. You warrant that you own or control the rights to your feedback and that it does not violate third-party rights.

12. Errors, Inaccuracies, and Omissions

We may correct errors, inaccuracies, or omissions in the Services at any time without notice, including after you place an order.

To the fullest extent allowed by law, AV Creations will not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of the Services or products. Our total liability will not exceed the amount you paid for the product that caused the claim.

You agree to indemnify and hold harmless AV Creations, Shopify, and their affiliates and agents from any claims or expenses arising from your breach of these Terms or misuse of the Services.

Failure to enforce any right does not waive that right. These Terms and posted policies are the entire agreement between you and AV Creations regarding the Services.

21. Governing Law

These Terms are governed by the laws of the State of North Carolina. You consent to jurisdiction in the state and federal courts located in Buncombe County, North Carolina.

We may update these Terms at any time. Material changes will be posted with an effective date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
